Homeland Security releases new employer regulations for verification of immigration status

Below are a series of documents regarding the Department of Homeland Security’s announcement of new regulations specifying the responsibilities of an employer to verify the immigration status of employees.

  1. A Fact Sheet on the Department’s “E-Verify” system, a “re-branding” of the Department’s “Basic Pilot” program which was begun in 1997. By the end of August, this system is supposed to add a new photo screening tool allowing employers to check new hires against 14.8 million images stored in the Department’s immigration database.
  2. A Fact Sheet on the Department’s new policy regarding the steps an employer should take when receiving a “No-Match” letter from the Social Security Administration indicating that an employee’s name and social security number do not match SSA’s records.
  3. A copy of the form letter from the Department that will apparently accompany future “No-Match” letters from SSA and inform employer’s what steps they should take in response.
  4. An outline of the steps the Department and other federal agencies will be taking in the future to improve immigration compliance and border security, including worksite enforcement measures.
  5. The actual proposed rule, which I understand will be published in the Federal Register tomorrow.
